Governed by the Laws of Kenya

Terms of Service

Last Updated: September 12, 2026. These terms constitute a legally binding agreement between you and Mooud Technologies Limited (Nairobi, Kenya).

1. Operating Entity & Scope

These Terms of Service govern access to and use of the Mooud mobile and web application services. These terms are established by:

Mooud Technologies Limited
A private company limited by shares, incorporated in Kenya under the Companies Act, 2015
Registered Office: Nairobi, Kenya
Company Registration Number: (pending)

By accessing, registering, or checking out of services, you enter into a binding contractual agreement with Mooud Technologies Limited under the Law of Contract Act (Cap 23) of the Laws of Kenya.

2. Your Consumer Rights Under Kenyan Law

Article 46 of the Constitution of Kenya, 2010 gives every consumer the right to goods and services of reasonable quality, to the information necessary to gain full benefit from them, to the protection of their health, safety and economic interests, and to compensation for loss or injury arising from defective goods or services. The Consumer Protection Act, 2012 and the Sale of Goods Act (Cap 31) give that effect. Nothing in these terms removes or limits those rights.

  • Cancelling an internet agreement: Under section 44 of the Consumer Protection Act, you may cancel an agreement entered into over the internet within seven (7) days of receiving a copy of it if we did not disclose the information the Act requires, or did not give you an express opportunity to accept, decline or correct errors before you committed.
  • Goods that never arrive: Under section 45, if we or a seller on Mooud fail to deliver within thirty (30) days of the promised date, you may cancel and are entitled to a refund.
  • Our own returns promise, which is wider than the law requires: For physical goods, we voluntarily offer a return window of fourteen (14) daysfrom receipt, provided the item is unused and in its original packaging. Return carriage to the regional hub is at the buyer’s expense. This is a commitment we choose to make; it is not a statutory cooling-off right, and we will tell you before we ever change it.
  • Digital content and AI features: When you trigger an AI generation — a Naya summary, an Aura scan, a Vibefy render — you are asking us to perform the service immediately. Once the output is produced, that particular generation has been supplied and cannot be returned. The credits or tokens you have not yet spent remain yours.
  • Event tickets:Digital tickets are refundable up until the event begins, subject to the organiser’s stated policy shown to you at checkout. Once an event has begun, a ticket to it has been supplied.

3. AI Wellness Disclaimers (Aura & Naya)

Medical Disclaimer

Mooud’s AI tools, including Aura Analysis (facial skin wellness scan) and Naya Wellness Coach (voice companion), are not a health service and do not constitute or substitute for licensed professional medical advice, clinical diagnosis, or therapy. Mooud Technologies Limited is not registered as a health facility under the Health Act, 2017, and nobody operating these features is holding themselves out as a practitioner registered under the Medical Practitioners and Dentists Act (Cap 253). The wellness recommendations, dietary lists and skin assessments are generated for motivational, physical-wellness and aesthetic purposes only. Always consult a registered practitioner for any healthcare question.

4. SKIP Rides & Dispatch Courier Framework

Kenya regulates ride-hailing platforms directly rather than treating them as neutral intermediaries. Mooud’s SKIP Ride and courier dispatch module operates as a Transport Network Company under the National Transport and Safety Authority (Transport Network Companies, Owners, Drivers and Passengers) Regulations, 2022.

  • Licensing: Operating this module requires a valid NTSA Transport Network Company licence. Every driver accepting trips must hold a current PSV driving licence and PSV badge, and every vehicle must hold a valid PSV licence, inspection certificate and PSV insurance. We verify these before a driver is dispatched a passenger, and a driver whose papers lapse stops receiving trips.
  • What we take from a fare: The 2022 Regulations cap the commission a Transport Network Company may charge a driver at 18% of the fare. Mooud charges less than that ceiling, and the rate in force is shown to every driver in the app before they accept work. We will not raise it above the statutory cap.
  • Carrier liability: The transport contract is formed between the driver or courier and the passenger or shipper. Mooud operates and is accountable for the platform, the matching, the fare calculation and the payment — it does not drive the vehicle.
  • Fare estimates: Fares shown in-app before a trip are estimates based on distance, duration and time of day. The final fare is calculated on the trip actually taken and is settled in your regional currency.

5. Cross-Border Commerce, Duties & Taxes

Mooud connects buyers with suppliers inside and outside Kenya, including partners in Asia. When you order an item that has to cross a border into Kenya:

You act as the Importer of Record. Goods entering Kenya are assessed by the Kenya Revenue Authority under the East African Community Customs Management Act, 2004, and may attract import duty, excise duty where applicable, Value Added Tax under the VAT Act, 2013 at the prevailing rate, the Import Declaration Fee and the Railway Development Levy. You agree to settle those charges on entry of the goods. Where a price shown in the app excludes them, the app says so at checkout.

Where goods are shipped between two points outside Kenya, the destination country’s own customs rules apply and the same principle holds: the buyer is the importer.

6. Governing Law & Dispute Resolution

These Terms, all transactions, and all contractual relations between Mooud Technologies Limited and users are governed by the substantive laws of the Republic of Kenya.

If a dispute arises, please first write to legal@mooud.app so we can try to resolve it directly. If that does not settle it, none of the following is closed to you:

  • Competition Authority of Kenya: Consumer complaints may be lodged with the CAK, which enforces the consumer protection provisions of the Competition Act, 2010. See www.cak.go.ke for the current complaint channels.
  • Small Claims Court: For money claims up to the limit set under the Small Claims Court Act, 2016, the Small Claims Court is open to you. It is faster and far cheaper than the High Court, and you do not need an advocate. We will not object to a claim being brought there on the ground that these terms name another forum.
  • Courts: Non-consumer commercial disputes are submitted to the Commercial and Tax Division of the High Court of Kenya at Milimani, Nairobi. Nothing in this clause limits a consumer’s right to bring proceedings in the court nearest to them.
  • Arbitration: Cross-border commercial disputes between Mooud and a business counterparty may, by written agreement between the parties, be referred to arbitration under the Arbitration Act, 1995, seated at the Nairobi Centre for International Arbitration.
